Purpose of HIT Products

This Product Legal Disclaimer applies to products and services provided by Head Impact Trauma Limited ("HIT", "we", "us" or "our"), including HIT wearable devices, the HIT Athlete App, HIT Team App and associated HIT services.

HIT wearable devices are designed to record and display information relating to head impacts and movement during sporting and physical activities.

HIT products provide users with information including impact data and activity-related insights to help athletes, parents, coaches and support teams better understand recorded head-impact exposure.

HIT products and services are provided for informational, sporting and fitness purposes.

Not a Medical Device or Diagnostic Tool

HIT products are not medical devices and are not intended to diagnose, prevent or treat concussion, traumatic brain injury or any other medical condition.

A recorded impact, including an impact exceeding a threshold displayed within a HIT application, does not establish that an injury or concussion has occurred.

Equally, the absence of a recorded impact or alert does not establish that an injury has not occurred or that an individual is safe to continue participating in an activity.

HIT data should be treated as supplementary information and must not replace clinical assessment, professional medical advice or established concussion and return-to-play protocols.

Important Safety Information

If an athlete experiences symptoms including headache, pain, dizziness, confusion, loss of balance, nausea, blurred vision, loss of consciousness, seizure or any other unusual or concerning symptoms following an impact, they should stop participating in the activity and seek appropriate medical assessment.

Decisions about medical treatment, concussion assessment, return to activity or return to play should be made in accordance with appropriate medical advice and applicable sporting or clinical protocols.

Do not delay seeking medical attention because of information displayed - or not displayed - by a HIT product.

Sensor and Data Limitations

HIT wearable devices measure movement at the location where the device is attached. Recorded results may be affected by factors including device position, attachment method, helmet movement or fit, sporting environment and the circumstances of an impact.

No wearable sensor can guarantee that every relevant event will be detected or recorded in every environment.

HIT measurements should not be interpreted as a direct measurement of injury or physiological change within the brain.

Users are responsible for ensuring that HIT devices are appropriately attached, charged and used in accordance with HIT instructions.

Emergency Contact Functionality

Certain HIT services may allow a user to nominate an emergency contact and enable notifications following specified events.

Emergency-contact functionality is an additional information and communication feature. It is not an emergency-response or emergency-services system and must not be relied upon as the sole means of obtaining assistance in an emergency.

SMS and other communications depend upon factors outside HIT's control, including mobile network availability, internet connectivity, device connectivity, carrier services, regulatory requirements and geographic availability. Messages may therefore be delayed, unavailable or undelivered.

Responsibility and Liability

Sport and physical activity may involve inherent risks, including the risk of head impact and injury. Use of HIT does not eliminate those risks.

Nothing provided through a HIT product, application or service constitutes medical advice.

To the fullest extent permitted by applicable law, HIT is not responsible for injury, loss or damage arising solely from a user's reliance upon HIT data as a substitute for appropriate medical assessment, established safety procedures or emergency assistance.

Nothing in this disclaimer excludes or limits liability where it would be unlawful to do so.
