These Terms & Conditions ("Terms") govern the purchase and use of products, applications, websites and services provided by Head Impact Trauma Limited ("HIT", "we", "us" or "our").

Head Impact Trauma Limited is registered in Scotland, UK under Company No. SC564020.

By purchasing or using a HIT product or service, you agree to these Terms. Nothing in these Terms affects any statutory rights you may have as a consumer.

1. HIT Products and Services

HIT provides wearable head-impact monitoring devices, applications and related digital services designed to record and display information relating to head impacts and sporting activity.

Features and functionality may vary depending on the device, application, subscription, account type, territory and version of the HIT service being used.

We may update our products, software, applications and services from time to time to improve performance, security, functionality or regulatory compliance.

2. Product Information and Medical Disclaimer

HIT products and services are intended to provide supplementary information relating to recorded head impacts and sporting activity.

HIT products are not medical devices and are not intended to diagnose, prevent or treat concussion, traumatic brain injury or any other medical condition.

A HIT alert or recorded impact does not establish that an injury has occurred. The absence of an alert or recorded impact does not establish that an injury has not occurred or that an athlete is safe to continue participating.

HIT data must not replace appropriate medical assessment, professional medical advice, established concussion protocols or emergency services.

3. Accounts

Certain HIT services require an account.

You are responsible for providing accurate and current information, maintaining the confidentiality of your account credentials, taking reasonable steps to prevent unauthorised access to your account, and notifying HIT if you believe your account has been compromised.

You must not access another person's account without appropriate authorisation.

Where HIT services are used by teams, organisations, schools, research organisations or other groups, those organisations are responsible for ensuring that appropriate permissions and consent arrangements are in place for the individuals whose information they manage.

4. Purchasing HIT Products

Product descriptions, prices and availability are displayed on our website at the time of purchase.

We take reasonable care to ensure that product descriptions and pricing information are accurate. If we identify a material error affecting an order, we may contact you before fulfilling it and provide appropriate options.

Prices, delivery charges and other charges payable to HIT will be displayed or communicated as part of the purchasing process.

For orders delivered outside the United Kingdom, customs duties, import taxes, clearance charges or other charges may be imposed by the destination country. Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer.

5. Payment and Subscriptions

Payment must be made using one of the payment methods made available during checkout.

By submitting an order, you confirm that you are authorised to use the payment method provided.

Where HIT offers paid digital services or subscriptions, the applicable price, billing frequency, included services and renewal arrangements will be communicated when you subscribe.

HIT App and Premium Features


HIT products are designed to be used with the HIT App. Access to the core HIT App required to use your HIT device is provided without a recurring subscription fee.

HIT may also offer optional Premium features, functionality or services for an additional subscription fee. Premium features are additional to the core functionality of the HIT App and are not required in order to use the basic functionality of your HIT device.

The features included within the free and Premium versions of the HIT App may be updated or developed over time. Where a Premium subscription applies, the applicable price, billing frequency, included features and renewal terms will be displayed before you subscribe.

6. Shipping

Processing, dispatch and delivery of physical HIT products are governed by our Shipping Policy:

Delivery times are estimates and may be affected by circumstances outside HIT's reasonable control, including courier delays, weather, customs processing and international border requirements.

7. Returns, Cancellations and Refunds

Returns and refunds are governed by our Returns Policy:

Nothing in these Terms or our Returns Policy affects statutory cancellation, refund, repair or replacement rights available under applicable consumer law.

8. Product Warranty

HIT products are subject to our Warranty Policy:

Our commercial warranty is provided in addition to, and does not replace or restrict, statutory rights available under applicable consumer law.

Details of the applicable warranty period, coverage, exclusions and claims procedure are contained in the Warranty Policy.

9. HIT Applications and Software

HIT grants users a limited, personal, non-exclusive and non-transferable right to use HIT applications and software for their intended purpose, subject to these Terms.

You must not, except where permitted by law, copy or commercially exploit HIT software, circumvent security or access controls, interfere with HIT systems, use HIT services unlawfully, or attempt to obtain unauthorised access to HIT systems, accounts or data.

10. Service Availability

We aim to provide reliable access to HIT services but cannot guarantee uninterrupted or error-free availability.

Services may occasionally be unavailable because of maintenance, software updates, network conditions, third-party services, regulatory requirements or circumstances outside our reasonable control.

Where reasonably practicable, we will work to restore affected services as quickly as possible.

11. Emergency Contact Notification Service

About the Service

The HIT Athlete App may allow a user to nominate an individual as their emergency contact.

Before an emergency contact is enrolled to receive HIT emergency contact SMS notifications, that individual must agree to receive the messages.

Once an individual has accepted a request to become an emergency contact, HIT may send automated SMS notifications to the mobile telephone number provided when an emergency notification is triggered in connection with the relevant HIT user.

Messages may contain information about a recorded high-impact event, the time of an event, location information where available, and a request to contact or check on the athlete.

The service is informational only. It is not an emergency-response service and does not provide a medical diagnosis or confirmation that an injury has or has not occurred.

Consent to Receive SMS Messages

By accepting a request to become a HIT emergency contact, you consent to receive automated SMS emergency contact notifications from HIT at the mobile telephone number provided.

Participation is voluntary. Consent to receive SMS messages is not a condition of purchasing HIT products or services.

Message Frequency

Message frequency varies.

HIT emergency contact notifications are event-triggered rather than sent according to a regular schedule. The number of messages received will therefore depend on events associated with the HIT user for whom you have agreed to act as an emergency contact.

Msg & data rates may apply.

Charges for sending or receiving SMS messages are determined by your mobile carrier and mobile service plan.

STOP - Opting Out

Reply STOP to any HIT SMS message to stop receiving HIT SMS emergency contact notifications.

After opting out, you will receive confirmation and will no longer receive HIT emergency contact SMS notifications unless you subsequently opt in again.

Where available, you may also withdraw your emergency-contact consent through the HIT emergency contact service.

HELP - Getting Assistance

Reply HELP to a HIT SMS message for assistance, or contact HIT at info@hitrecognition.com.

Availability and Delivery

Emergency-contact SMS notifications are provided using third-party telecommunications services and are subject to network, carrier, technical, regulatory and geographic availability.

The service may not be available in every country or territory, and availability may change.

Messages may occasionally be delayed or may not be delivered.

Carriers are not liable for delayed or undelivered messages.

The HIT Emergency Contact Notification Service must not be relied upon as the sole means of obtaining emergency assistance. Where urgent medical or emergency assistance is required, contact the appropriate emergency services.

Location Information

Where the relevant functionality is enabled and location information is available, an emergency notification may contain location information associated with the event.

Availability and accuracy of location information may depend on the user's mobile device, permissions, GPS availability, connectivity and other technical factors.

Privacy and SMS Data

Personal information associated with the SMS Emergency Contact Notification Service is processed in accordance with our Privacy & Cookie Policy.

HIT does not sell or share SMS opt-in data, mobile telephone numbers or SMS consent information with third parties or affiliates for marketing or promotional purposes.

Service providers may process information on HIT's behalf where necessary to operate and deliver the SMS service.

12. Intellectual Property

HIT products, applications, software, website content, branding, designs, graphics, text and associated intellectual property are owned by or licensed to Head Impact Trauma Limited unless otherwise stated.

Nothing in these Terms transfers ownership of HIT intellectual property to a user.

You may not reproduce, distribute, modify or commercially exploit HIT intellectual property without permission except where permitted by law.

13. Personal Information

We process personal information in accordance with our Privacy & Cookie Policy.

Where you provide information relating to another individual, including an emergency contact, you must ensure that the information is accurate and that its provision is lawful.

14. Research and Anonymised Data

Where permitted by applicable law and our Privacy & Cookie Policy, HIT may use appropriately anonymised or aggregated information for research, product development, validation and improvement of HIT technology.

Information that identifies an individual will be handled in accordance with our Privacy & Cookie Policy and applicable data-protection law.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Subject to applicable law, HIT is not responsible for loss or damage caused solely by use of HIT products contrary to their instructions or intended purpose; reliance upon HIT data as a substitute for medical assessment or professional advice; failure of third-party telecommunications, internet, GPS or mobile services outside HIT's reasonable control; or unauthorised account use resulting from a user's failure to take reasonable steps to protect their credentials.

Nothing in these Terms affects statutory consumer rights.

16. Suspension or Termination

We may suspend or restrict access to a HIT service where reasonably necessary for security, maintenance, regulatory compliance, suspected misuse or a material breach of these Terms.

Where reasonably practicable and appropriate, we will notify affected users.

17. Changes to These Terms

We may update these Terms where reasonably necessary to reflect changes to our products, services, technology, legal requirements or regulatory obligations.

Material changes will be communicated where required by applicable law.

The current version will be published on the HIT website with the date of the latest update.

18. Governing Law

These Terms are governed by the laws of Scotland, subject to mandatory consumer protections that may apply in the country in which you reside.

Nothing in this section deprives a consumer of rights available under applicable consumer law.
